USER TERMS AND CONDITIONS
These Terms and Conditions ("T&C") govern the membership and use of the SplitPoints Loyalty Program (the "Programme"), operated by SplitPoints Marketing Solutions Pvt. Ltd. ("SplitPoints," "we," "us"). By registering for or using the Programme, the Member ("you") agrees to be bound by these T&C.
1. Definitions
- SplitPoints Loyalty Program (Programme): The loyalty mechanism and platform operated by SplitPoints.
- Participating Partner (Partner): Any retail, service, or e-commerce entity that has an agreement with SplitPoints to offer benefits to Members.
- Member: An individual who has successfully enrolled in the Programme and holds a valid account.
- Splitpoints/Rewards: The loyalty currency or benefits accrued by the Member under the Programme.
2. Membership and Eligibility (Indian Contract Act, 1872)
- Eligibility: Splitpoints are available to registered account holders only. Accounts must be in good standing to earn or redeem points.
- Contractual Capacity: Membership is open to Indian residents who are at least 18 years of age and competent to contract under the Indian Contract Act, 1872. Minors may not enroll.
- Account Use: Only one account can be used per transaction.
- Non-Transferability: The SplitPoints account and accrued Splitpoints are non-transferable and may only be used by the registered Member. Splitpoints cannot be transferred to other accounts.
3. Accumulation of Splitpoints
- Earning Rate: The number of SplitPoints awarded per purchase is set by each Participating Partner individually and will be communicated to the Member at the point of sale.
- Redemption Value: 10 SplitPoints are equivalent to ₹1 in redemption value across all Participating Partners.
- Accrual and Display: To collect points, present your SplitPoints card or scan the app at checkout. Points will appear in your account as Pending within 24 hours of the transaction. Pending points will become available to spend subject to the Participating Partner's return policy. Where the Partner has no stated return policy, points will become fully available within 3 working days of the transaction.
- Accrual: To collect points, present your Splitpoints card or scan the app at checkout. Points will be credited to your account within X days.
- Exclusions: Splitpoints cannot be earned on purchases paid using previously redeemed points.
- Misuse/Fraud: Points may be reclaimed, withdrawn, or adjusted if purchases are made in bulk or for resale, if issued incorrectly, or in cases of suspected fraud or misuse.
4. Redemption of Splitpoints
- A minimum of 500 Split Points (equivalent to ₹50) must be redeemed in a single transaction.
- Partner Minimum Threshold: Participating Partners may, at their sole discretion, impose additional redemption conditions, including minimum spend thresholds or other restrictions. Any Partner-set minimum threshold shall not exceed the Programme-wide minimum of 500 SplitPoints, as communicated to Members under this clause.
- Finality: Your Splitpoints balance updates immediately after redemption. Redeemed points cannot be converted back into points.
- Availability: Goods, services, and discounts are subject to availability and may change at any time.
5. Returns, Cancellations, and Forfeiture
- Adjustments: If a purchase is returned or an order is cancelled, credited points will be reversed. Splitpoints used in cancelled or incomplete orders will be returned to your account according to retailer rules.
- Inactivity Forfeiture: Splitpoints/Rewards may expire or be forfeited if the account is inactive for a continuous period of 12 months or if these T&C are breached.
6. Member Obligations and Indemnity
- Accuracy of Information: The Member warrants that all information provided during registration is true, accurate, and current.
- Indemnity: The Member shall indemnify and hold harmless SplitPoints for any loss, claim, or damage caused by the Member's failure to provide accurate information or their breach of these T&C.
- Card Security: The Member is responsible for the security of their SplitPoints Card and account credentials. SplitPoints shall not be liable for any unauthorised use of the Card or points redemption.
- Misuse: SplitPoints reserves the right to terminate membership and cancel all accrued Splitpoints immediately if the Member is found to be misusing the Programme.
7. Account Suspension and Termination
- Immediate Suspension: Where SplitPoints has reasonable grounds to suspect a breach of these T&C, fraud, or misuse of the Programme, the Member's account will be suspended immediately, pending investigation. The Member will be notified by email to their registered address.
- Investigation: SplitPoints will conduct a prompt and fair investigation. The Member may be contacted for information during this period.
- Termination on Breach: If the investigation confirms a breach of these T&C, the Member's account will be terminated. SplitPoints will notify the Member of the outcome and the reason for termination.
- Cancellation of Points: Where SplitPoints determines that points were earned through a violation of these T&C — including fraudulent transactions, collusion with a Partner, or misrepresentation — those points will be cancelled in full without compensation.
- No Obligation to Restore: SplitPoints is under no obligation to restore a terminated account or cancelled points where a breach is confirmed.
- Appeals: A Member who believes their account was suspended or terminated in error may submit an appeal to info@splitpoints.com within 14 days of receiving the termination notice. SplitPoints will review and respond within 30 days.
8. Limitation of Liability (Protection Clause)
- No Warranty on Partner Goods/Services: SplitPoints is solely a loyalty programme operator. SplitPoints is not responsible for the quality, fitness for purpose, or availability of any goods or services provided by Participating Partners. Any claim related to goods/services must be directed to the Partner.
- Maximum Liability: SplitPoints' maximum liability to a Member for any loss, damage, or claim arising from the Programme shall be strictly limited to the monetary value of the accrued, unredeemed Splitpoints/Rewards in the Member's account at the time the claim arose. SplitPoints shall not be liable for any indirect, incidental, special, or consequential damages.
- Errors: Splitpoints is not responsible for errors, omissions, or losses resulting from the use of points, except as required by law.
9. Force Majeure
SplitPoints shall not be held liable for any failure or delay in performing its obligations under these T&C where such failure or delay results from events beyond its reasonable control, including:
- Acts of God, natural disasters, floods, earthquakes, or extreme weather events;
- Epidemic, pandemic, or public health emergencies declared by a competent authority;
- War, civil unrest, terrorism, or government-imposed sanctions or regulations;
- Cyberattacks, hacking, or malicious interference with the Programme's IT systems;
- Failure or outage of third-party internet, telecommunications, or payment infrastructure;
- Regulatory actions, government orders, or changes in applicable law that prevent or restrict performance.
In the event of a force majeure event, SplitPoints will use commercially reasonable efforts to notify Members and resume normal operations as soon as practicable. The affected obligations shall be suspended for the duration of the event and shall not constitute a breach of these T&C.

11. Programme Changes and Intellectual Property
- Programme Changes: SplitPoints reserves the right to modify, suspend, discontinue, or withdraw the Programme or these T&C at any time, with or without notice. Continued use constitutes acceptance of any changes.
- Partner Terms: Splitpoints rewards are subject to the terms of Participating Partner companies. Partner companies may impose additional rules or restrictions on earning and redeeming points.
- Intellectual Property: The SplitPoints name, logo, website content, and Programme mechanism are the sole intellectual property of SplitPoints and are protected under Indian law. Unauthorised reproduction or use is strictly prohibited and constitutes a breach of contract.
12. Data Protection and Privacy
12.1 Data Collection and Lawful Basis
- SplitPoints collects personal data (including name, contact details, and transaction history) solely for the purpose of administering the Programme, processing point accrual and redemption, and communicating Programme updates.
- Personal data is processed on the basis of the Member's consent given at registration and for the performance of the Programme agreement.
- Members may withdraw consent at any time by contacting admin@splitpoints.com, subject to impact on their ability to participate in the Programme.
12.2 Data Principal Rights (DPDP Act 2023)
- Right of Access: Members may request a summary of the personal data held by SplitPoints.
- Right to Correction: Members may request correction of inaccurate or incomplete personal data.
- Right to Erasure: Members may request deletion of their personal data, subject to legal retention obligations. Account closure results in deletion within 90 days.
- Right to Grievance: Members may raise a data protection complaint to info@splitpoints.com. If unresolved, Members may approach the Data Protection Board of India.
- Right of Nomination: Members may nominate an individual to exercise data rights on their behalf in the event of death or incapacity.
12.3 Data Retention
- Transaction data will be retained for 5 years from the date of transaction, as required under applicable Indian law.
- Account data will be retained for 90 days following account closure, after which it will be securely deleted.
13. Governing Law and Jurisdiction
- Governing Law: These T&C and the Programme shall be governed by and construed in accordance with the laws of India.
- Jurisdiction: All disputes arising out of or in connection with these T&C shall be subject to the exclusive jurisdiction of the Courts located at Thrissur, Kerala, India.
- Dispute Resolution: Any dispute shall first be attempted to be resolved amicably through good-faith negotiation. Failing such resolution within 30 days, either party may seek recourse through the designated courts.
